The first court setting that a Defendant attends with an attorney is usually uneventful. The attorney and the client will check-in with the court staff to let them know they are there. The Defendant will usually have a seat in the hall or in the court room. The attorney will then go to the area where the prosecutors and other defense attorneys are meeting.

In the meeting room is where the attorneys are gathering information from the prosecutors file, completing paperwork to get a copy of the prosecutor’s file and depending on the circumstances begin to negotiate with the prosecutor. If no resolution is obtained, the case is usually reset for another date so that the attorney and prosecutor can continue to negotiate or set the case for a guilty plea or for a trial.
